Terms of Service

These terms cover your use of Sell On Hand. By creating an account or using the service, you agree to these terms.
1. What the service is
Sell On Hand is software for vendors who sell in person. It tracks inventory, takes payment at an event by cash or card, keeps a contact list, sends follow-up texts, and hosts a public page for your products.
We provide the software. We do not stock, ship, inspect, or endorse anything you sell.
2. Who is selling what
You are the seller of your goods. The contract for the item is between you and your customer. You are responsible for describing it accurately, having it in stock, delivering it, honoring your own return policy, and complying with any law that applies to what you sell.
We are the merchant of record for the card payment. When a customer pays by card, the charge settles to us and we transfer your share to your connected Stripe account. Our name may appear on the customer's card statement, and we carry the card network's liability for a disputed charge. That does not make us the seller of your goods.
Cash sales are between you and your customer. We only record them.
3. Your account
You need an account to use the service. You must be at least 18 and able to enter a contract. Keep your sign-in credentials secure and contact us at support@sellonhand.com if you believe your account has been compromised. You are responsible for activity under your account.
The demo account is a shared public sandbox. It resets periodically, its contents are visible to anyone using it, and it cannot take card payments. Do not enter real customer information in it.
4. Fees
- $5 per month: inventory, live selling, offline store, email receipts, and email campaigns on sellonhand.com, including the monthly email allotment published on the pricing page. Cash-only vendors pay this subscription; there is no transaction fee on cash sales. SMS is not included.
- Branded, starting at $10 per month plus a one-time setup fee: the same features, plus your own domain and your name on the login, checkout, and receipt. JE with Me may be offered at a promotional branded rate.
- Card sales, 4.2% + $0.35 per transaction on every plan, deducted before your share is transferred. This covers card processing; there is no separate processing fee on top.
- Cash sales have no transaction fee. The monthly subscription still applies.
- Optional add-ons such as SMS receipt buckets, SMS campaign buckets, extra email, and Photo Fill are sold separately at the prices published on the pricing page.
The fixed $0.35 fee applies to every card sale, so the effective rate is higher on small amounts.
Subscription fees are billed monthly in advance and are not prorated on cancellation. We may change prices with at least 30 days' notice. Price changes take effect on your next billing period. You may cancel before then if you do not want to continue at the new price.
5. Payouts
Card payouts run through Stripe Connect. To receive them you must complete Stripe's onboarding and accept the Stripe Connected Account Agreement, which is between you and Stripe. Stripe decides whether to approve your account and controls the payout schedule. We cannot override either.
Until Stripe has cleared your account, card checkout is disabled in the app. Cash checkout remains available. We do not hold your funds as a deposit and we are not a bank.
6. Refunds, returns, and disputes
Goods you sold. You set and honor your own return policy. Tell your customers what it is. When you refund a card sale, the amount refunded to the customer is deducted from your share. Our 4.2% platform fee on that sale is not returned, because card networks do not return their processing costs to us.
Chargebacks. If a customer disputes a charge with their bank, we will notify you and ask for evidence that the sale was legitimate. If the dispute is lost, the disputed amount and any related fee may be recovered from your future payouts or invoiced to you.
Your subscription. You may cancel at any time from the app or by contacting us. Cancellation takes effect at the end of the billing period you have already paid for. We do not refund partial months. If a service failure on our side prevented you from using a paid month, contact us and we will address it.
7. Prohibited uses
You may not use Sell On Hand to break the law, and you may not sell anything Stripe prohibits. That list is published by Stripe and binds both of us. You also agree not to:
- Take payment for goods you do not have or do not intend to deliver
- Use the service to process payments for someone else's business
- Text people who have not agreed to hear from you, or ignore an opt-out
- Upload personal information you have no right to hold
- Access another vendor's data, or probe, scrape, or overload the service
8. Customer information
Your contact list belongs to you. We store it for you and act on your instructions. We do not market to it or share it with other vendors. You are responsible for collecting it lawfully, telling those people how you will use it, and having their permission before you text them. See our Privacy Policy for how data is handled.
9. Text messages
Sell On Hand runs two separate text programs on two separate numbers. Consent for each is collected at checkout, in unchecked-by-default boxes the shopper checks themselves. A shopper with an account can also turn vendor updates on or off for each vendor from their shopper profile, but only for a mobile number they typed in themselves at that vendor's checkout.
Purchase receipts
Program name: Sell On Hand purchase receipts. A shopper chooses "Text me a receipt," types their own number, and checks the receipt consent box. A replica is at sellonhand.com/sms-consent. Typically one message per completed purchase. Message and data rates may apply.
Vendor follow-up updates
Program name: Sell On Hand vendor updates. A shopper checks a separate "Stay in touch" box to hear from that vendor again: new items, restocks, and event announcements. They type their own mobile number. A replica is at sellonhand.com/sms-marketing-consent. Shoppers manage these per vendor under Updates from stores in their shopper profile, which shows the same disclosure. Frequency varies by vendor; typically a few messages per month. Message and data rates may apply.
HELP replies with support information. STOP opts the number out of further texts from that program's number. Support: support@sellonhand.com. Privacy Policy: Sell On Hand Privacy Policy. Mobile numbers are not shared with third parties for their own marketing. Carriers are not liable for delayed or undelivered messages.
10. Content and software
Content you provide (products, photographs, prices, contacts, sales records) remains yours. You grant us permission to store and display it only as needed to operate the service, including on any public page you choose to publish.
The software, design, and brand of Sell On Hand belong to us. Using the service does not transfer any of those rights to you.
11. Availability and disclaimers
We aim to keep the service available, including during weekends when many vendors are at events. We do not guarantee uninterrupted or error-free service, and the service depends on third-party providers we do not control. The service is provided as is, without warranties of any kind, to the extent permitted by law.
You should maintain a backup method of recording sales in case of connectivity or device failure.
12. Limits on liability
To the maximum extent permitted by law, Johnny Outlaw, LLC is not liable for indirect, incidental, or consequential losses, including lost sales or lost profits. Our total liability for any claim is capped at the greater of the fees you paid us in the three months before the claim, or $100.
Nothing in these terms limits liability that cannot legally be limited.
13. Termination
You may close your account at any time. We may suspend or close an account that breaks these terms, that puts us in breach of Stripe's rules, or that we are required to act on. Where it is reasonable to give notice first, we will.
On closure you may export your data. After a reasonable period we delete what we are not required to keep.
14. Changes to these terms
We may update these terms. The date at the top will change when we do, and material changes will be noted in the app. Continued use of the service after a change constitutes acceptance of the updated terms.
15. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules, and the courts of Texas have jurisdiction over any dispute.
